S.B. vs Lawyer
Our client's child had been severely asphyxiated at birth. They had retained a lawyer who had the case for five years. In that time he took no depositions and obtained very few of the medical records. The only expert opinion he obtained was from his family doctor to the effect that there was no case. The defendants offered no money. The trial was coming up in a few weeks and the parents wanted to switch lawyers.
We took over the case and negotiated a settlement with the defendant hospital for a small amount. The insurance claims supervisor was willing to testify that had the first lawyer done his work, the claim would have been paid for full value. We then sued the lawyer claiming that he should have paid attention to the case and that if he had, the insurance company would have paid the full amount. The lawyer's insurance company eventually paid the full value of their insurance policy.
